Fractology B.V. is a company established in the Netherlands. Our programs focus on fashion design education for learners across Canada. We operate from the Netherlands and bill tuition in EUR.

By using this website or enrolling in a course, you agree to these Terms.

2) Acceptance of Terms

By accessing our site, requesting enrollment, or participating in any course, you confirm that you have read, understood, and agree to be bound by these Terms and all policies referenced here, including our Privacy Policy and Cookie Policy. If you do not agree, do not use our services.

3) Services and Educational Nature

We provide online fashion design education through live sessions, guided assignments, and learning materials. Our programs are not accredited, and we do not guarantee job placement, grades, income, or any specific outcome. Content may be delivered by an invited specialist, an expert in the topic, or a specialist in fashion design.

4) Eligibility

• You must be at least 16 years old. If you are under 18, a parent or legal guardian must consent to your participation.
• You are responsible for having the hardware, software, tools, and internet connection needed for your selected course.
• You may enroll from Canada or elsewhere; billing and legal jurisdiction remain in the Netherlands.

5) Accounts and Access

If we provide student accounts or private links, you must keep credentials confidential and use them only for your personal learning. You are responsible for all activities under your access. We may suspend or revoke access for misuse, breach of these Terms, or non-payment.

6) Enrollment and Tuition

• Enrollment begins when you submit a request via the website and we confirm availability and next steps by email.
• Tuition is quoted and invoiced in EUR by Fractology B.V. Your card or bank may convert to your local currency.
• Schedules are planned to be workable for Canadian time zones when possible; specific times may vary and are not guaranteed.

7) Payments and Invoices

• Invoices are issued by Fractology B.V. in EUR. Any applicable Dutch taxes will be indicated on the invoice.
• Payment due dates appear on the invoice. Late or missing payments may lead to access restrictions or cancellation.
• You are responsible for any bank or currency conversion fees charged by your provider.

8) Cancellations and Refunds

• Before the course start date: you may cancel in writing for a full refund.
• Within 7 calendar days after the first live session or course opening (whichever occurs first), and provided you have accessed less than 20% of the materials: you may request a full refund.
• After the window described above or after accessing 20% or more of the materials: refunds are not provided for delivered sessions or unlocked modules.
• If we cancel a course in full, we will refund prepaid tuition for undelivered portions.
• Refunds are paid in EUR to the original payer. Processing times depend on your bank or payment provider.

Nothing in this section affects any non-waivable rights you may have under Dutch law.

9) Student Conduct

• Be respectful in live sessions and forums. Harassment, hate speech, or disruptive behavior is not permitted.
• Submit original work. Do not infringe copyrights, trademarks, or other rights of third parties.
• Do not share meeting links, recordings, or course materials outside your personal learning use.
• We may remove access for violations to protect other learners and the integrity of the program.

10) Intellectual Property

All course materials, including recordings, slides, templates, assignments, and site content, are owned by Fractology B.V. or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use materials solely for your personal, non-commercial study during the course and, where provided, for a reasonable review period afterwards. Any reproduction, distribution, public sharing, or commercial use requires our prior written permission.

11) Your Work and Submissions

You retain rights to your original work produced during the course. By submitting work to us for feedback, you grant Fractology B.V. a non-exclusive license to view, store, and display your submission for teaching, assessment, and internal quality assurance. With your explicit consent, we may feature selected work in the Gallery; you can withdraw that consent at any time for future displays.

12) Third-Party Tools and Software

Some modules require third‑party software or services (for example, digital illustration tools). You are responsible for obtaining valid licenses and complying with third‑party terms. We do not control third‑party tools and are not responsible for their availability or performance.

13) Privacy and Cookies

We handle personal data in line with our Privacy Policy. Cookies and similar technologies are described in our Cookie Policy. By using the site, you acknowledge these notices.

14) Changes to Services

We may update course content, schedules, and features to improve quality or reflect availability of invited specialists. If a material change affects your current enrollment, we will inform you by email and outline available options.

15) Disclaimers

• Services are provided on an “as is” and “as available” basis.
• We do not make promises of guaranteed results, employment, or certification beyond confirmation of completion where applicable.
• We do not warrant uninterrupted or error‑free access, though we aim for reasonable continuity and clear communication.

16) Limitation of Liability

To the maximum extent permitted under the laws of the Netherlands, Fractology B.V. and its directors, officers, staff, invited specialists, and contractors shall not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, goodwill, or other intangible losses. Our aggregate liability for direct damages arising out of or related to the services shall not exceed the greater of €100 or the total tuition you paid to us for the course giving rise to the claim during the 12 months preceding the event.

Some limitations may not apply if prohibited by law. Your statutory rights remain unaffected.

17) Indemnity

You agree to indemnify and hold harmless Fractology B.V. from and against claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the services, to the extent permitted under Dutch law.

18) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including but not limited to power outages, internet failures, strikes, pandemics, or actions of authorities. We will make reasonable efforts to resume services or offer alternatives when feasible.

19) Changes to These Terms

We may update these Terms from time to time. The “Effective date” at the top shows the latest version. If changes materially affect your current enrollment, we will notify you by email. Continued use of the site or services after changes means you accept the updated Terms.

20) Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Netherlands, without regard to conflict of laws rules. The courts of the Netherlands shall have exclusive jurisdiction, and proceedings shall be conducted in English or Dutch as applicable by the court.
